These Terms of Use (“Terms”) govern your access to and use of Opticare Academy, including all learning materials, courses, resources, content, webinars, live sessions, and related services provided through the platform.
By accessing or using Opticare Academy, you agree to comply with these Terms.
2. Eligibility & Access
Opticare Academy is intended for:
- Opticare customers
- Approved practice team members
- Opticare staff and authorised users
Access to Opticare Academy is provided at the discretion of Opticare.
We reserve the right to approve, suspend, restrict, or remove access to any user or organisation at any time.
3. User Accounts
Users are responsible for:
- Maintaining the confidentiality of their login details
- Ensuring account information remains accurate
- All activity conducted under their account
Users must not:
- Share login credentials with others
- Allow unauthorised access to their account
- Attempt to access restricted areas of the platform
Each user must maintain their own individual account.
4. Intellectual Property
All content within Opticare Academy, including but not limited to:
- Courses
- Videos
- Training materials
- Documents
- Graphics
- Branding
- Resources
- Webinar content
- Downloadable materials
is the property of Opticare or its licensors and is protected by applicable intellectual property laws.
Content must not be:
- Copied
- Reproduced
- Distributed
- Shared externally
- Modified
- Republished
without prior written permission from Opticare.
5. Permitted Use
Opticare Academy is provided for:
- Professional learning
- Practice development
- Internal training
- Educational purposes related to the optical industry
Users agree to use the platform responsibly, respectfully, and lawfully.
Users must not:
- Misuse the platform
- Upload harmful, misleading, or inappropriate content
- Attempt to interfere with platform functionality or security
- Use the platform for unauthorised commercial purposes
- Engage in disruptive or inappropriate behaviour during webinars, discussions, live sessions, chats, or comments
6. Community Guidelines
To help maintain a professional and supportive learning environment, all users are expected to:
- Treat instructors, Business Development Managers (BDMs), Opticare team members, and fellow learners with professionalism and respect
- Participate constructively during webinars, live sessions, chats, discussion areas, and comments
- Avoid inappropriate, offensive, discriminatory, abusive, or disruptive behaviour
- Respect differing perspectives and professional discussions
- Refrain from sharing confidential or sensitive information in public discussion spaces
Opticare reserves the right to remove comments, restrict participation, or suspend access where behaviour is deemed inappropriate or inconsistent with these guidelines.
7. Courses, Assessments & Certificates
Some courses may include:
- Assessments
- Knowledge checks
- Completion requirements
- Certificates of completion
Completion requirements may vary depending on the course.
Certificates issued through Opticare Academy do not currently provide accredited CPD points unless explicitly stated.
8. In-Person Training
Opticare may offer in-person training sessions in addition to online learning content.
Participation, availability, and scheduling of in-person training may vary and are subject to approval and availability.
9. Platform Availability
While we aim to maintain reliable access to Opticare Academy, we do not guarantee uninterrupted or error-free operation.
Access may occasionally be affected by:
- Maintenance
- Technical issues
- System upgrades
- Third-party service interruptions
10. Suspension or Termination of Access
Opticare reserves the right to suspend or terminate access to Opticare Academy where:
- A customer account becomes inactive
- These Terms are breached
- Access is no longer authorised
- Platform misuse is identified
User learning records may be retained in accordance with operational and legal requirements.
11. Privacy
Your use of Opticare Academy is also governed by our Privacy Policy .
By using the platform, you acknowledge and agree to the collection and use of information in accordance with our Privacy Policy.
12. Indemnification
By using Opticare Academy, you agree to indemnify and hold harmless Opticare, its employees, representatives, Business Development Managers, instructors, affiliates, and partners from and against any claims, liabilities, damages, losses, or expenses arising from:
- Your misuse of the platform
- Your breach of these Terms
- Your violation of any applicable law or third-party rights
- Any content or material you submit, share, or distribute through the platform
13. Limitation of Liability
To the maximum extent permitted by law, Opticare will not be liable for:
- Any indirect or consequential loss
- Loss of data
- Loss of business opportunities
- Interruptions to platform access
- Reliance on course materials or content
Users are responsible for applying professional judgement when using information provided through the platform.
14. Governing Law
These Terms are governed by the laws of New South Wales, Australia.
By using Opticare Academy, you agree to submit to the exclusive jurisdiction of the courts of New South Wales in relation to any dispute arising from or connected with these Terms or the use of the platform.
15. Changes to These Terms
We may update these Terms from time to time.
Updated versions will be published within Opticare Academy and will take effect upon publication.
Continued use of the platform constitutes acceptance of the updated Terms.
